GENERAL TERMS AND CONDITIONS My Kinda Skincare

Article 1 - Definitions

  • My Kinda Skincare: My Kinda Skincare, registered in Amsterdam, with Chamber of Commerce number 83637869.
  • Customer: the individual with whom My Kinda Skincare has entered into an agreement.
  • Parties: My Kinda Skincare and the Customer jointly.
  • Consumer: A Customer who is also an individual acting as a private person.

Article 2 - Applicability

These terms and conditions apply to all quotations, offers, activities, orders, agreements, and deliveries of services or products by or on behalf of My Kinda Skincare. Deviations from these conditions are only possible if agreed upon in writing by both My Kinda Skincare and the Customer. These terms exclude any other terms of the Customer or third parties.

Article 3 - Prices

My Kinda Skincare applies prices in euros, including VAT and excluding any additional costs such as administration or shipping, unless otherwise agreed upon in writing. Prices on the website and other materials may be adjusted. Customers have the right to cancel an agreement due to a price increase, unless it is a statutory adjustment.

Article 4 - Samples and Models

Receiving a sample or model of a product is only an indication of its nature unless agreed in writing that the delivery matches the sample.

Article 5 - Payments and Payment Term

Full payment is required at the time of ordering, which is processed at checkout. My Kinda Skincare may request a deposit for custom or bulk orders.

Article 6 - Right of Reclamation

In the event of default, My Kinda Skincare may exercise the right to reclaim unpaid products by notifying the Customer.

Article 7 - Right of Withdrawal

Consumers may cancel an online purchase within 30 days. This right does not apply if:

  • the product has been used or is not suitable for return for hygiene reasons;
  • the product is part of a set and the set has been partially used;
  • the product is personalized or customized.

The 30-day cooling-off period starts the day after the final product in the order is received. To use the withdrawal right, email orders@mykindaskincare.com with "Return" and the order number in the subject line. The Customer must return the product within 7 days of notifying the intent to withdraw.

Article 8 - Shipping Cost Reimbursement

If the purchase is canceled on time, My Kinda Skincare will refund any shipping costs paid by the Customer within 14 days.

Article 9 - Return Shipping Costs

Return shipping costs are the responsibility of the Customer.

Article 10 - Conformity and Warranty

My Kinda Skincare warrants that products conform to the agreement, specifications stated in the offer, and reasonable standards of reliability and usability. My Kinda Skincare does not provide additional warranties beyond those required by law.

Article 11 - Delivery and Execution

My Kinda Skincare will process accepted orders with due care. Delivery addresses provided by the Customer are binding. Stated delivery times are indicative and do not constitute a deadline. If delivery is delayed, the Customer will be notified as soon as possible.

Article 12 - Liability

My Kinda Skincare's liability is limited to the invoice value of the order. My Kinda Skincare is not liable for indirect or consequential damages, including loss of profit, reputational damage, or damages resulting from electronic communications such as lost, delayed, intercepted, or corrupted messages. In all cases, liability is limited to the amount covered by My Kinda Skincare's insurance, if applicable.

Article 13 - Force Majeure

My Kinda Skincare is not obliged to fulfill any obligation in the event of force majeure, including but not limited to strikes, government measures, natural disasters, pandemics, or supplier failures. My Kinda Skincare will notify the Customer as soon as possible in such cases.

Article 14 - Complaints

Complaints about products or services must be submitted within a reasonable time after discovery, with a full description of the issue. My Kinda Skincare will respond within 14 days. If more time is needed, an acknowledgment will be sent within 14 days with an expected resolution date.

Article 15 - Disputes and Applicable Law

All agreements between My Kinda Skincare and the Customer are governed by Dutch law. Disputes will be submitted to the competent court in Amsterdam, unless mandatory consumer law provides otherwise.

Article 16 - Privacy

My Kinda Skincare processes personal data in accordance with its Privacy Policy, available on the website. Personal data is processed in compliance with the General Data Protection Regulation (GDPR).

Article 17 - Intellectual Property Rights

All content on the My Kinda Skincare website, including but not limited to texts, images, logos, trademarks, and product descriptions, is the property of My Kinda Skincare and protected by copyright and other intellectual property rights. Nothing may be reproduced, copied, or published without prior written permission from My Kinda Skincare.

Article 18 - Changes to Terms

My Kinda Skincare reserves the right to amend these terms and conditions at any time. Changes will be published on the website. For ongoing agreements, changes will take effect 30 days after notification, unless the Customer objects in writing within that period.
